INFORMATION ON PROCESSING OF PERSONAL DATA PURSUANT TO ART. 13 AND SS. Reg. U.E. 679/16 AND D. LGS. 196/2003

First of all, the website www.pastacavallari.it is owned by the company “PAC di Cavallari Paolo” based in Baone (PD), in Via Cà Borini n. 19/ A, VAT number no. 04556760280, in the person of its legal representative Cavallari Paolo, tel. 0429 601622, e-mail amministrazione@pastacavallari.it, PEC pastacavallari@pecpdcna.it and that this privacy policy applies exclusively to the online activities of the website www.pastacavallari.it and is valid for visitors/users of the site.

Does not apply to information collected through channels other than this website.

In compliance with the obligations arising from national and Community legislation on the protection of personal data, this information is therefore:

b – Purpose and legal basis of the processing

B1) The processing of your personal data will be carried out for the following purposes:

  1. Management of the website registration process and possible participation in related initiatives;
  2. Provide the requested information by filling out the contact form;
  3. Allow online purchases, in relation to the products offered on the website and according to the conditions of sale;
  4. Sending commercial newsletters, offers, promotions, discounts, invitations to events and/ or events via e-mail and/ or WhatsApp;
  5. Compliance with legal obligations of a fiscal, administrative, tax, etc. nature (for example administration customers/ suppliers; management of the contractual relationship; invoicing; order management; receipts and payments);
  6. Defence in any trial (civil, criminal, administrative, etc.);
  7. Sending, exclusively to the e-mail address provided by you during the registration or purchase of a product, promotional messages on goods or services similar to those purchased by you (c.d. soft spam), unless you object to the processing in accordance with point e) below.

The legal basis of the processing is the fulfilment of the contract (points 1, 2 and 3), the consent of the data subject (point 4), the legal obligation to process the data (point 5), the pursuit of the legitimate interest of the controller (points 6 and 7).

B2) We specify that your browsing data acquired by the computer systems and software procedures of this website is also processed for its normal operation. This is information that is not collected to be associated with identified data subjects, but that by its very nature could, through processing and associations with data held by third parties, allow users to be identified. These data are used only for the purpose of obtaining anonymous statistical information on the use of the site and to check its proper functioning. In addition, they could be used to establish liability in the event of hypothetical computer crimes at the dates of the site.

These data are collected on the basis of the consent expressed by the user through persistent navigation on the site (conclusive behavior).

c – Recipients of personal data

The personal data related to the processing in question, for the purposes referred to in the previous point, may be communicated:

  • To those within the organization of the Holder who have the need for the effect of the job covered. These subjects are the persons authorized to process data under the direct authority of the Controller pursuant to art. 4 para. 10 Reg. EU 679/16;
  • To entities whose activity is necessary for the execution of contracts in which you are a party or to fulfill specific requests (such as carriers, suppliers, etc.);
  • To third parties to whom the Data Controller may outsource certain activities and who, as a result, provide the Client with certain instrumental services, however related to the processing and the purposes described above, such as administrative services, accounting, tax, auditing, computer system and website management, debt collection, mass archiving. These subjects carry out processing on behalf of the Data Controller and are authorised to process the data as Data Processors in accordance with art. 28 Reg. EU 679/16.

If it is deemed appropriate, the Data Controller will be able to identify precisely such third parties directly to the interested party who requests it.

The data collected will not be disseminated and/or transferred to third countries.

d – Storage period

The Data Controller will keep the registration and accounting data relating to purchases for ten years from the last use or until the end of any litigation procedure.

The data collected by filling out the contact form will be kept for sixty days from the last contact.

For marketing purposes, the data collected will be stored for 24 months.

e – Methods of processing

The processing will be carried out by means of computer and telematic tools with logics strictly related to the purposes for which they were collected in compliance with the principle of limitation of purposes as well as all the other principles present in article 5 of Regulation 679/2016. In particular in compliance with the principles of integrity and confidentiality, pursuant to which specific security measures are taken to prevent data loss, illegal or incorrect use and unauthorised access.

f – Place of processing

The processing of data related to the web services of the site takes place mainly at “PAC di Cavallari Paolo” based in Baone (PD), in Via Cà Borini n. 19/A, by the entities duly authorised for processing and, where appropriate, with the collaboration of other entities specifically designated as data processors.

g – Your rights

At any time you may exercise, pursuant to articles 15 to 22 of Regulation U.E. n. 2016/679, the right to:

  • Access to personal data;
  • Obtain the rectification and deletion of data, with the exception of data that must be retained by law;
  • Obtain the restriction of processing;
  • Object to the processing of your personal data at any time (art. 21). In particular, you can object to the processing of your data for the purpose referred to in point b) 1 n. 7 (c.d. soft spam) by accessing your Private Area or selecting the appropriate link on each commercial email sent.

This will make it impossible for the Owner to send you communications in order to promote the direct sale of products similar to those purchased.

  • Revoke the consent to send newsletters at any time without prejudice to the lawfulness of the processing based on the consent before the revocation;
  • Submit a complaint to the supervisory authority of the state in which you reside; if you are resident in Italy, you can contact the guarantor for the protection of personal data based in Rome.

h – Consequences of failure to provide data

For all the purposes indicated in point b), the conferment of the data is not mandatory; however, except for the purpose indicated in point b) n. 4 (sending newsletters) which is subject to separate and appropriate consent, the conferment of the data is necessary to register, Ask for information and make purchases on the website www.pastacavallari.it.

The provision of data in the fields marked with an asterisk is mandatory and their failure to enter does not complete the registration or request for information.
